Property Management Laws in Virginia
An important part of successfully managing your rental property is being well-acquainted with all the real estate laws that are set forth by the Federal and Virginia state government. As a landlord, being aware and respecting all legalities involved with managing your property is crucial in protecting you from any costly lawsuits. When you work with us, you can rest assured that you’ll be protected from any unwanted legal implications because all our property managers are experts and follow all the local laws.
Virginia Real Estate Licensing Laws
The leasing and renting of your property is considered a real estate activity under the current real estate laws in Virginia. Due to this fact, any property leasing and renting activities should be done by a licensed broker. Our skilled licensed brokers at VHS Management have been managing properties for over ten years!
Virginia Landlord-Tenant Laws
The Virginia Residential Landlord and Tenant Act (VRLTA) enforces the rental agreement between the landlord and tenant. Just like landlords have rights, so do tenants. According to VRLTA, tenants have certain rights when they move in, while they rent out your property and even before being evicted. We will ensure that your potential tenants are educated of their rights and that your leasing documents properly define them.
Federal Fair Housing Laws
The Fair Housing Laws offers tenants protection against discrimination when getting screened and submitting their rental application. Potential tenants must not be prevented from having a roof over their head based on their race, gender, ethnicity, or religion beliefs. When you work with us, we will ensure that your rental application is carefully and lawfully drafted.
How VHS Manages Your Property
01
Lease Preparation
VHS Property Management will provide and handle getting all the leasing documents signed with the new tenant. We use the standard Virginia Association of Realtors Lease with added addendums. The first Addendum tightens accountability and adds additional criteria to further protect you, the property owner. For example, insurance, handling of smoke detectors, instances of power outage, pets and more. The Second, Security Deposit Addendum, is added to remind tenants of their responsibilities upon move-out.
02
Marketing
We market your property through our local Multiple Listing Service which feeds out to many top real estate sites on the web. In addition, we cooperate with other Realtors to rent your home at no extra charge to you. This means we have access to even more agents to get your property rented fast. We also offer Property Showings that include the use of special lockboxes on vacant homes that allow potential renters timely access to view the property 7 days a week which leads to faster occupancy.
03
Pet Screening
We use PetScreening.com™ to help manage renters’ pets and assistance animals which allows us to offer our owners an additional layer of liability protection and a standardized, legally compliant process for dealing with household pets and assistance animals.
04
Property Evaluation
When you are ready to rent your property, we will prepare a market analysis to determine the best price for your home. We have a meticulous method for determining the value of your home. Our analyses are seasonal and on demand. We compare similar properties that have rented in the past and depending on the time of year, prices may be adjusted accordingly. We also factor in the number of current rentals available in a given area. Our goal is always to get top dollar for your rental property and to attract the best tenants.
05
Inspections
Regular inspections help to identify potential problems with your property and ensure that the tenant is in compliance with all lease terms. We will conduct move in and move out inspections and we will coordinate any maintenance or repair word orders. Move out inspections are completed within 72 hours of the move out date and tenants will be notified.
06
Real Estate
The Real Estate Store Inc. is the sales side our Brokerage. When you decide to purchase or sell a home and need an agent who will represent your best interests, The Real Estate Store, Inc. is here for you. With an experienced agent by your side, we will guide you through the entire process from listing the property at the right price, successful negotiations, choosing the right lender, finding a home inspector and much more. We are here for all your Real Estate needs. Referrals Welcome
07
Security Deposit
For your protection, all deposits are held by VHS Property Management in a separate escrow account.
08
Tenant Screening
We use a standard rental application process and we screen tenants using a scoring matrix with the minimum being 12 points. There are several categories within our system that allow for point scoring and the total points are tallied at the end. This method allows us to use several factors to determine eligibility, and provides a more inclusive rental application process. Cosigners are also welcome however, certain factors such as past rental debts and evictions result in an automatic denial of the application.
09
Tenant Relations
Keeping tenants happy, from the moment they move in to the moment they move out requires a high level of customer service. Making tenants happy also increases your rental renewals and positive online reviews of your property which ultimately increases your revenue. At VHS Managements, our high standards of quality service apply to you, the owner AND the tenant.
10
Lease Enforcement & Evictions
Evictions are complicated and require a high level of legal knowledge. In the case of your tenant repeatedly violating your lease terms and rental agreement, we will handle all court documents and processes, including lease terminations or evictions. When needed, we will coordinate the process for any garnishments or warrants in debt with the local civil court.
